These terms govern your use of getforgeworks.com and the products and services offered by DerMar Consulting Group LLC (dba "ForgeWorks").

1. Acceptance of terms

By accessing our website or using our products and services, you agree to be bound by these Terms & Conditions and our Privacy Policy. If you do not agree, please do not use our services.

2. Use of services

You agree to use our services only for lawful purposes and in accordance with these terms. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account.

3. SMS / Text Messaging Terms

When you opt in to our SMS program, you agree to these messaging terms:

Program: ForgeWorks (a brand of DerMar Consulting Group LLC) sends account notifications, appointment and demo reminders, customer-care replies, and occasional product updates.
Consent: You opt in by submitting a form with SMS-consent language on getforgeworks.com, providing your number at checkout, or texting our business number. Consent is not a condition of purchase.
Frequency: Message frequency varies.
Cost: Message and data rates may apply, per your mobile plan.
Opt out: Reply STOP at any time to cancel. You will receive one confirmation message and no further messages.
Help: Reply HELP for assistance, or email info@getforgeworks.com.
Carriers: Mobile carriers are not liable for delayed or undelivered messages.
Privacy: Your mobile opt-in data and consent are never shared with third parties for their marketing purposes. See our Privacy Policy.

4. Billing & subscriptions

Paid plans are billed through our payment processor (Stripe) on a recurring basis until cancelled. You may cancel at any time; access continues through the end of the current billing period. Fees are non-refundable except where required by law.

5. Intellectual property

All software, content, and trademarks on our site and within our products are owned by DerMar Consulting Group LLC or its licensors and may not be copied or used without permission.

6. Disclaimers & warranties

Our services are provided "as is" and "as available," without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the services will be uninterrupted, timely, secure, or error-free, or that any data will not be lost, corrupted, or rendered unavailable. You are solely responsible for maintaining your own backups of any data you consider important.

7. Limitation of liability

To the fullest extent permitted by law, DerMar Consulting Group LLC, its owners, members, employees, and affiliates shall not be liable for any loss of data, loss of revenue, loss of profits (including revenue or profits lost as a result of data loss, corruption, or unavailability), loss of goodwill, business interruption, or any indirect, incidental, special, consequential, exemplary, or punitive damages arising out of or relating to your use of, or inability to use, the services — whether based in contract, tort (including negligence), strict liability, or any other legal theory, and even if we have been advised of the possibility of such damages.

In all cases, our total aggregate liability for any and all claims arising out of or relating to the services shall not exceed the total amount you actually paid us for the services during the three (3) months immediately preceding the event giving rise to the claim. Some jurisdictions do not allow certain limitations, so portions of the above may not apply to you.

8. Governing law

These terms are governed by the laws of the Commonwealth of Pennsylvania, without regard to its conflict-of-laws principles.
